Rep. Jim Walsh shares remarks during floor debate on Senate Bill 5476, concerning the Supreme Court’s Blake decision

Rep. Jim Walsh, R-Aberdeen, discusses how Senate Bill 5476 only partly addresses aspects of the State Supreme Court's Blake decision, which declared the state's law criminalizing drug possession unconstitutional.

Walsh says the underlining bill does not go far enough, noting that the state should “support and defend lawful behavior.”

The 19th District lawmaker spoke in favor of an amendment he sponsored that would increase the penalty proposed in the underlying bill, raising it from a misdemeanor to a gross misdemeanor. He also shared remarks during final passage, calling the bill “flawed, hastily developed and thrust” upon lawmakers for a vote.
